TCPA Policy
Vertical Group LLC (“Vertical Group,” “we,” “our,” or “us”) is committed to full compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all related FCC regulations. This policy outlines the standards, responsibilities, and procedures we follow to ensure that all outbound calls, text messages, and lead generation activities comply with applicable federal and state laws regarding consumer consent and communication practices.
Scope
This policy applies to:
All employees, contractors, and affiliates of Vertical Group LLC
All marketing partners, publishers, and vendors engaged in performance-based or lead generation campaigns.
All channels of communication (e.g. voice, calls, text, prerecorded messages, and online forms)
TCPA Overview
The TCPA prohibits using automatic telephone dialing systems (ATDS), prerecorded voice messages, or SMS texts to contact consumers without prior express consent or, in some cases, prior express written consent. The law also regulates calling times, do-not-call (DNC) lists, opt-out mechanisms, and consent recordkeeping.
Consent Requirements:
(A) Prior Express Written Consent (for marketing calls/texts):
Vertical Group requires verifiable, documented consent before contacting any consumer for telemarketing or promotional purposes.
Consent Must:
Be clear and conspicuous.
Authorize contact via specified channels (calls, texts, or prerecorded messages).
Include the consumer’s signature (electronic or physical).
Disclose that consent is not required to make a purchase.
(B) Prior Express Consent (for informational/non-marketing communications):
Used for communications related to existing inquiries or transactions initiated by the consumer.
Prohibited Practices
Vertical Group strictly prohibits:
The use of auto-dialers or prerecorded messages without the required level of consent.
Contacting any consumer on the National Do Not Call (DNC) registry unless prior consent exists.
Calling or texting outside the permitted hours of 8:00 AM – 9:00 PM (local time).
Using misleading caller ID information or deceptive content.
Purchasing or using leads without documented, transferable TCPA-compliant consent records.
Lead Sourcing and Verification
Vertical Group maintains rigorous vendor and affiliate compliance standards:
All third-party leads must include timestamped consent records with originating URLs, IP addresses, and opt-in disclosures.
Vertical Group audits lead sources periodically to verify authenticity and consent trail integrity.
Partners must retain consent proof for at least four (4) years from the date of collection.
Non-compliant vendors will be terminated immediately and may be reported to regulatory authorities.
Opt-Out Procedures
Every marketing communication must provide a clear and easy opt-out mechanism, including:
Reply STOP functionality for SMS/MMS messages.
Verbal or keypad-based removal for calls.
A visible unsubscribe link or email address for online communications.
All opt-out requests must be processed within 10 business days.
Do-Not-Call (DNC) Compliance
Vertical Group maintains an internal DNC list, which is updated continuously. No person who has opted out or requested removal may be contacted again. DNC suppression applies across all campaigns, affiliates, and call centers. National and state-level DNC registries are scrubbed regularly against outbound lists.
Recordkeeping
To ensure compliance, Vertical Group maintains:
Consent records, call logs, and opt-out logs.
Vendor compliance certificates.
Audit reports and training documentation.
Records are stored securely and made available for regulatory review if required.
Training & Oversight
All employees, agents, and vendors undergo TCPA compliance training upon onboarding and annually thereafter. Vertical Group’s Compliance Officer reviews this policy quarterly and oversees adherence through audits and monitoring systems.
Enforcement
Violations of this policy may result in disciplinary action, contract termination, or legal referral. Vertical Group reserves the right to seek indemnification from any vendor or affiliate whose actions cause TCPA violations or related claims.
